GLENPOOL, Okla. – The man who originally pleaded guilty and was sentenced to 120 years in prison for raping a 12-year-old girl is seeking to withdraw his guilty plea.
Kevin Smith, 51, agreed to enter the guilty plea in January. Smith claims he agreed to a 30 year sentence for each of his four counts and would serve them concurrently. Instead, a judge sentenced him to 40 years for each count to be served consecutively.
Smith was previously convicted of eight counts of distribution of child pornography and one count of possession of child pornography. He was sentenced in January to 17 1/2 years.
