Rogers County DA's office to stay on Bixby case

The Rogers County District Attorney's Office will prosecute the sexual assault case against four Bixby High School football players.

Their defense attorneys reached up to the appellate court to divert the case but lost their bid.

Defense attorneys made the appeal because they think the Rogers County DA's Office is too close to the victim's family - specifically claiming assistant district attorney kali strain -  use to babysit the assault victim.

The Tulsa County DA stepped away from the case because of conflict of interest.

Attorneys for the four accused football players filed a motion to disqualify Rogers County from the case.

When that was denied by the judge - they appealed it.

But the decision came down Monday - which stated that District Attorney Matt Ballard's office would stay on the case.

Four football players are accused of raping a teammate last year at former Bixby Superintendent Dr. Kyle Wood's house.

Wood resigned shortly after the news broke.

The next hearing is scheduled for Monday - at 1:30 p.m.
