OSBI arrests son for killing his father in 2012

MARLOW, Okla. - Oklahoma State Bureau of Investigation said they have a arrested a son for killing his father in August 2012.

James Kyle Brooks, 37, has been charged with one count of first degree murder with deliberate intent.

OSBI special agents said James Brooks called police from his father Timothy Brooks' home and reported his father had committed suicide by shooting himself in the stomach with a shotgun. 

The medical examiner stated that although it was highly unlikely Timothy Brooks shot himself, he believed it was possible, agents said.

The case went cold for several years until the Marlow Police Department requested OSBI to look at the case again.

While looking at the case, OSBI agents found that James Brooks had taken out a $500,000 life insurance policy on his father.

Agents said the policy had a two-year suicide clause, meaning if a person killed themselves within a two-year timeframe, the policy would not pay out.

The shooting happened two years and six months after the policy was issued, agents said.

Agents stated James couldn't explain how the shotgun had recycled after the trigger had been pulled. 

James claimed his father was cleaning the 12-gauge shotgun prior to the shooting, but officers and detectives did not find any cleaning materials, agents stated.
