TULSA – After spending more than a year behind bars, one man is walking free, according to his legal representation.
Keaundrey Carter was arrested on accusation of robbery with a firearm in September of 2015. Authorities claimed Carter threatened a man and a woman at gunpoint, then stole a cell phone from them.
This week, however, Carter’s attorney says the case was dismissed by the Tulsa County District Attorney's office “without prejudice.” In this case, says the Tulsa County DA's office, Carer was arrested on "probable cause" and during the preliminary hearing, a judge ruled there was enough evidence to take the case to trial.
Then because prosecutors were unable to get one of the victims to appear in court due to a scheduling conflict, the victim is reportedly a "over-the-road truck driver," the state filed a motion that the case continue.
The Tulsa County DA's office went on to explain that a judge denied the motion to continue and based on that ruling, the state dismissed the case "because they cannot proceed to trial without victim testimony."
Carter’s attorney went on to clarify that the case was dismissed in part because of two witnesses who were unable to testify on the scheduled court date in February.
