A neighbor's fallen branch, tree, fence, or other property can damage your property but who has to pay?
John Wiscaver with State Farm Insurance says "People get confused, they're under the misunderstanding that legally if your tree lands on my house all of the sudden I should knock on the your door and say your tree's on my home, can you come and get it off."
One attorney tells us the bottom line. If your tree was healthly and there was no indication it would fall under normal circumstances you're not legally liable for any damage caused by the tree.
If the tree just falls on your property and doesn't damage your home it's up to you to pay to have the tree cut up and removed.
If a tree damages your vehicle State Farm tells us that's usually covered as long as you have comprhensive coverage.
