A Copan man faces charges for multiple offenses committed during his arrest on Sunday, among those alleged offenses being spitting on a police officer.
Johnny Dale Chinn, 48, was arraigned Monday at the Washington County Courthouse where his bond set at $20,000 and was charged with domestic abuse, public intoxication, obstruction of an officer and transferring bodily fluids on an officer.
According to the affivadit filed by Dewey police, an officer seated taking a meal break at La Fiesta restaurant in Dewey at around 5 p.m. Sunday was approached by another patron and was informed of a man having a heated conversation with a woman who just exited the restaurant.
The report said the officer later made contact with the woman, identified as Tina Chinn, and noting her behavior and other evidence, advised the woman she had been drinking and arguing with her husband. The officer told her he would not allow her to drive in her condition and she would need to arrange a ride, which she did.
The officer then made contact with the man -- who was drinking a margarita -- and informed him he would need to leave the restaurant with his wife's ride or call a ride, according to the report.
The report said Chinn "poured out a cup of hot sauce and poured his magarita into it and asked 'Is that legal to take?'" to which the officer responded it was illegal to transport out of the restaurant.
According to the affidavit, the officer observing Chinn leave the restaurant and climb into a vehicle that had since arrived noticed Chinn shove his wife into the vehicle's back seat and "push the front passenger seat into her face."
The report said the officer then approached the vehicle, informed Chinn he was under arrest for public intoxication and domestic abuse and placed him in handcuffs. According to the officer, Chinn attempted to pull away while he was being walked to the patrol car and then refused to sit in the vehicle.
The affidavit said Chinn's wife then approached the officer "several times" before she got close enough that the officer "had to shove her back." The wife returning again, the officer then placed her under arrest for obstruction. As he attempted to place her in handcuffs, she struggled with the officer, forcing him to place her to the ground, where she rolled onto her back still struggling, the report said.
According to the affidavit, as the officer struggled with Chinn's wife, Chinn attempted to walk over to the officer to kick him but was restrained by another citizen.
The officer then after bringing Chinn's wife under control handcuffed her and returned to her husband and placed him in the back seat of the patrol car. As the officer attempted to close the door, Chinn kicked at the door keeping the officer from closing it. The door eventually closed, Chinn attempted to kick the glass out.
After ordering Chinn to stop and Chinn continuing to kick at the door's window, the officer applied his batton to a pressure point on Chinn after which Chinn then settled down, according to the affidavit.
The report said three Bartlesville police officers then arrived to the scene and Chinn's wife was then transported to the Washington County Sheriff's Department, after which Chinn returned to kicking at the left rear door's glass and ordered the officer to take him directly to the sheriff's office.
According to the report, after having completed taking information from witnesses, the officer began to drive Chinn toward Bartlesville when Chinn began to spit from the back seat onto the back of the head and face of the officer.
The report said on the third or fourth attempt after being ordered to stop spitting, Chinn "began to suck air for another spit" and "leaned over the seat again," when in an attempt to stop him, the officer slammed on the brakes. Chinn continuing to spit, the officer repeated the action and then contacted Bartlesville dispatch to have a detention officer at the office ready for his arrival. The officer then activated his lights and sirens and ran emergency status for the duration of the trip to the sheriff's office where Chinn was removed from the vehicle by detention staff and taken to a security cell "after a brief struggle in the parking lot in which Mr. Chinn was taken to the ground," according to the affidavit.
Chinn's next court date is set for Nov. 13.
Chinn's wife was charged with public intoxication, obstructing an officer and resisting arrest. She was later released after posting bond.
