TULSA - Two youth ministers who are suspended from Victory Christian Center and charged with failing to report child abuse filed a motion to dismiss the charges Friday, according to court documents.

John and Charica Daughtery's attorney, Jason A. Robertson, contends since no one has been found guilty of child abuse, the Daughterys can’t be charged with failing to report child abuse.

 “Neither of the alleged perpetrators of the underlying crimes has been charged with abuse or sexual abuse of a child,” Robertson writes in the motion. “Defendants John and Charica should not be charged with failure to report child abuse when the underlying crimes do not fall within the specific definitions of those particular charges. “

John and Charica along with Paul Willemstein, Anna Alisa George and Harold Frank Sullivan were suspended by Victory Christian administrators for not following Victory’s policy regarding child abuse, Victory Christian officials have said.

Chris Denman and Israel Castillo were arrested for several claims of rape, lewd molestation, sodomy and using a computer to facilitate a sex crime against underage girls. Both have pleaded not guilty.
