Oklahoma man to be executed for 1986 shooting death

McALESTER, Okla. (AP) -- An Oklahoma man who fatally shot his fiancee in 1986 is slated to be executed despite his pleas that he is mentally incompetent and ineligible for the death penalty.

Fifty-six-year-old Garry Thomas Allen is set to die by lethal injection Tuesday evening at the Oklahoma State Penitentiary in McAlester.

Allen was convicted of shooting Lawanna Gail Titsworth outside a children's day care in Oklahoma City. Titsworth had moved out of the home she shared with Allen and their two sons just days before her death.

Allen's attorneys had argued that Allen was incompetent when he entered a guilty plea in the case and that his mental condition has continued to deteriorate, but appellate courts have rejected those claims.

Allen's attorney has requested a stay from the U.S. Supreme Court.
