TULSA - After a year and a half of waiting, an Oklahoma district attorney and officer in the Air National Guard is receiving back pay and benefits accrued during his time in combat.

A judge sided with Col. Rex Duncan earlier this week in his drawn out battle with the state of Oklahoma, which chose to relieve him of his office following a 11-month deployment to Afghanistan.

Gov. Mary Fallin reinstated Duncan upon his return, but the DA opted to continue his lawsuit against the state in order to set a precedent for other military members in elected office.

"...It's a good day for the men and women of the Guard and Reserve and that part is priceless," he said.

Monday's ruling cited USERRA, a federal law protecting the jobs of military members while performing an active duty requirement.
