Susan Witt, with the Tulsa County DIstrict Attorney's office, said they will not ask for the death penalty in the murder case of Neal Sweeney.

Witt wouldn't comment on why they are not seeking the death penalty.

23-year-old Terrico Bethel pleaded not guilty to a first-degree murder charge.

Neal Sweeney was working when he was shot in the head in September of last year.

He died the next day.

Police say their investigation revealed that Sweeney's killing was the result of a business dispute.

Bethel is scheduled to be in court again on February 26.
