An Ochelata man faces charges related to the rape of a girl a year-and-a-half ago now 13 years old.
Dewey police on Tuesday arrested Jason Scott Smith, 28, on a charge of first-degree rape by instrumentation upon a person under 14 years of age.
During a hearing held Wednesday at the Washington County Courthouse, the judge set Smith’s bond at $100,000.
According to the affidavit, a police officer assigned to a lewd molestation case on Dec. 15, 2009, spoke with the mother of the alleged victim. The officer learned a rash that had developed on the girl prompted the mother to take her daughter to the Jane Phillips Medical Center in Bartlesville. The daughter then diagnosed with herpes, the mother questioned the daughter on how she had contracted the virus. The girl told her mother Smith had touched her inappropriately.
Police then on Dec. 30 speaking with the girl’s younger sister learned that she had witnessed Smith touching her older sister while she slept in the living room of a residence on the 1000 block of N. Shawnee in
Dewey, according to report.
Investigators determined the incident occurred sometime between July 18 and 21, 2008, said the report.
According to the affidavit, Smith told police upon his arrest that the girl’s father — who had been incarcerated during the week of the alleged molestation due to failure to pay child support —made the accusation of molestation against him because Smith owed him $40 for a failed drug buy.
Smith’s next court appearance is scheduled for Feb. 5.
